In mainland China, the phenomenon of selling electronic cigarettes to primary school students is very serious. It is reported that there are traders in Guizhou who openly sell "three no electronic cigarettes" to primary school students. In fact, this is not a single phenomenon. As far as the events we have collected before, this is quite common. Primary school students are not consumers of vapes, but now they have to bear the danger of counterfeit vapes, which is the result that our vape manufacturers do not want to see.
Smokers may not care about other things, but in the use of smoke, smokers will always become the most discerning and even the most "thin" customers. There are many brands on the market, each with its own loyal users, and even some smokers, who can use a brand of cigarettes for decades.
When it comes to vapes, the situation is still the same. This fact is determined based on the current vape market group composition. Despite the rise of vapes and the mixedness of the industry, vapes still lack strength compared to the huge market for traditional cigarettes.
For most smokers, vapes are more like a novel "smoking method", which may be understood but not familiar. For those smokers who have used or are ready to use vapes, there are two reasons for choosing vapes: First, they love it. From the perspective of traditional cigarettes, the taste of vapes is not superior to cigarettes. But this does not prevent some smokers from having a preference for the taste of vapes.
Another larger group of vapes is based on their own health considerations. As a new type of thing, vapes have been labeled as "healthy than cigarettes" and "smoking cessation artifacts".
It can be seen that in the minds of smokers, vapes are products for health purposes, but if you buy counterfeit and shoddy products, the counterfeit products may cause unpredictable harm to the body. This completely contradicts the original intention of vape products, so both smokers and regular vape manufacturers hope that the government can crack down on these counterfeit vape products.
Since May 2015, Shenzhen Baoan police launched the first shot of “Combating Counterfeit Electronic Cigarettes”, and five suspects were arrested. In the following three years, the “counterfeiting” of electronic cigarettes across the country has never been relaxed.
For example, in 2015, on August 6th of that year, the Shenzhen Municipal Public Security Bureau and the Market Supervision Bureau jointly launched a crackdown on a factory that produces and sells counterfeit electronic cigarettes in Shajing Central Road, Baoan District, and seized a batch of them on the spot. The electronic cigarette product of the aspire registered trademark is not authorized.
This year, Rugao Technology, which produced the "world's first vape", also launched a "counterfeiting" lawsuit, which brought the vape brand "taste like smoke" to the Beijing Chaoyang District People's Court.
At present, according to the official website of the National Standardization Administration, the national standard of "electronic cigarette" has entered the review stage. At the end of last year, the "General Standard for Electronic Cigarettes" jointly drafted by the Shenzhen Electronic Cigarette Chamber of Commerce and related senior electronic cigarette companies has also been officially implemented.
At the same time, Articles 213 and 216 of the Criminal Law of China clearly define the crime of counterfeiting registered trademarks and the crime of counterfeiting patents. At the same time, the Trademark Law also provides for punitive damages for acts of malicious infringement of the exclusive right to use a registered trademark.
It is undeniable that the current vape market in China, due to the initial barbaric development, still has a mixed situation. However, in the context that vape smokers do not choose and the regulatory laws do not allow it, so-called counterfeit vapes can only be swollen in the dark corners until the last breath is swallowed.
